Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and ClassKite (“ClassKite”, “we”, “us”, or “our”) and govern your access to and use of our website at classkite.com and the ClassKite classroom platform (together, the “Service”). By creating an account, subscribing to a plan, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

ClassKite is an education service used by individual teachers, students, and schools to run interactive lessons, generate and deliver practice, annotate materials on a smart board, and review classroom progress. Some users of the Service are children. If you are using the Service on behalf of a school or organization, you accept these Terms for that organization and confirm that you are authorized to do so. Please also read our Privacy Policy, which explains how we handle personal information.

1. Who may use the Service

You may use the Service only if you can form a binding contract with ClassKite and only in compliance with these Terms and all applicable laws. The Service is intended for teachers, school administrators, and adult account holders. Students — including children — may use the Service only through, and under the supervision of, a teacher or school that has accepted these Terms on their behalf and is responsible for obtaining any consent required by law. If you are a teacher or school, you are responsible for the use of the Service by the students you invite or manage.

2. Your account

To use most features you must create an account. You agree to provide accurate, current information and to keep it up to date. You are responsible for safeguarding your password and for all activity that occurs under your account. Do not share your credentials, and notify us at support@classkite.com if you believe your account has been compromised. We may refuse, suspend, or reclaim a username or account at our reasonable discretion, for example to protect the Service or comply with the law.

3. Roles, classes, and student data

The Service supports different roles — teacher, student, and school administrator — with different permissions. Where a school or teacher uses ClassKite to deliver lessons and practice to their own students, that school or teacher determines how student information is used in their classes, and ClassKite processes that information on their behalf as described in our Privacy Policy. If you are a school or teacher, you represent that you have provided any notices and obtained any consents required for the students you add, and that you are entitled to share their information with the Service for the purposes of operating your classes.

4. Subscriptions, plans, and free tiers

Some features of the Service are free and others require a paid subscription. We currently offer plans including a free Basic teacher plan, a paid Plus teacher plan, and School plans for organizations. The features, usage limits, and prices of each plan are described on our Pricing page at the time you subscribe. We may change the features and limits of a plan, introduce new plans, or retire plans; where a change materially reduces a paid feature you are using, we will give reasonable notice.

5. Billing, renewals, and cancellation

Paid plans are offered on a recurring subscription basis (for example monthly or annual) and are billed in advance through our third-party payment providers, which currently include Stripe and PayPal. By subscribing, you authorize us and our payment providers to charge your chosen payment method for the applicable fees, including recurring charges, until you cancel.

  • Automatic renewal — subscriptions renew automatically at the end of each billing period at the then-current price for your plan, unless you cancel before the renewal date.
  • School billing — School plans are billed per block of seats (currently in blocks of fifteen seats). The number of blocks you purchase determines how many student or teacher seats your organization may use.
  • Cancellation — you may cancel a subscription at any time from your account or by contacting us. Cancellation stops future renewals; your paid access generally continues until the end of the current billing period.
  • Price changes — we may change subscription prices. We will give you reasonable advance notice of a price change, and it will take effect on your next renewal after the notice period.
  • Taxes — fees are exclusive of taxes unless stated otherwise. You are responsible for any applicable taxes, and we may collect them where required.

6. Refunds

Except where required by applicable law, payments are non-refundable and we do not provide refunds or credits for partial billing periods, unused features, or downgrades. If you believe you have been charged in error, contact us at support@classkite.com and we will review the matter in good faith. Nothing in these Terms limits any statutory rights you may have as a consumer, including any applicable right of withdrawal.

7. Acceptable use

You agree to use the Service responsibly and in a way that is appropriate for an educational setting. You may not, and may not allow anyone using your account to:

  • break the law, infringe others’ rights, or violate the privacy of students or any other person;
  • upload, generate, or share content that is unlawful, harmful, harassing, hateful, sexually explicit, or otherwise inappropriate for a classroom;
  • attempt to access accounts, data, or systems you are not authorized to access, or interfere with or disrupt the Service;
  • probe, scan, or test the vulnerability of the Service, or circumvent its security, rate limits, or usage limits, except as part of an authorized security test;
  • use bots, scrapers, or automated means to access the Service in a way that places an unreasonable load on it, except for permitted public indexing;
  • reverse engineer, copy, resell, or create derivative services from the Service except to the extent this restriction is prohibited by law; or
  • misrepresent your identity, role, or affiliation, or use the Service to send spam or malware.

8. Your content

The Service lets you upload, create, and share materials such as documents, PDFs, images, questions, practice, and annotations (“Your Content”). As between you and ClassKite, you retain the rights you hold in Your Content. You grant ClassKite a worldwide, non-exclusive license to host, store, reproduce, adapt, and display Your Content solely as needed to operate, secure, and improve the Service and to provide it to the users you share it with (for example the students in your classes). You are responsible for Your Content and represent that you have the rights necessary to upload it and to grant this license, and that it does not infringe the rights of others.

9. Our intellectual property

The Service, including its software, design, text, graphics, and logos, and all intellectual property rights in it, belong to ClassKite or its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for its intended educational purpose. These Terms do not transfer any ownership in the Service to you, and you may not use our name or branding without our prior written permission.

10. Third-party services

The Service relies on and may link to third-party services, including payment providers and hosting and infrastructure providers. Your use of those services may be subject to their own terms and privacy policies, and we are not responsible for third-party services that we do not control. Links from the Service to third-party sites are provided for convenience and do not imply our endorsement.

11. Availability, changes, and beta features

We work to keep the Service available and reliable, but we provide it on an “as is” and “as available” basis and do not guarantee that it will be uninterrupted or error-free. We may modify, suspend, or discontinue features of the Service, and we may offer features that are experimental or labelled as beta, which may change or be withdrawn. We will try to avoid material disruption to paid features and to give notice where reasonable.

12. Disclaimers

To the fullest extent permitted by law, the Service is provided without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements, that content or AI-generated practice will be accurate or complete, or that defects will be corrected. You are responsible for reviewing generated materials before using them with students. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

13. Limitation of liability

To the fullest extent permitted by law, ClassKite and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, revenue, or goodwill, arising out of or relating to your use of or inability to use the Service. To the fullest extent permitted by law, ClassKite’s total liability for all claims relating to the Service in any twelve-month period will not exceed the amounts you paid to ClassKite for the Service during that period, or, if you use the Service for free, one hundred euros (€100). Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

14. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless ClassKite from any claims, damages, and reasonable expenses (including legal fees) arising out of your violation of these Terms, your misuse of the Service, or your infringement of the rights of any third party, including in relation to Your Content or to the students you manage. This section does not apply to the extent a claim results from ClassKite’s own breach of these Terms or its negligence.

15. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms, if your use poses a risk to the Service or other users, if required by law, or if we discontinue the Service. On termination, your right to use the Service ends; sections that by their nature should survive — including content licenses you have granted, disclaimers, limitations of liability, and indemnities — will continue to apply. Following termination we will handle any personal information as described in our Privacy Policy.

16. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Changes take effect when posted unless we state otherwise. Your continued use of the Service after changes take effect means you accept the updated Terms; if you do not agree, you should stop using the Service.

17. Governing law and disputes

The Service is operated from and hosted within the European Union. These Terms, and any dispute arising out of or relating to them or to the Service, are governed by the laws applicable at ClassKite’s place of establishment, without regard to conflict-of-law rules, and you agree that the competent courts of that jurisdiction will have jurisdiction over such disputes. This does not deprive you of the protection of any mandatory consumer-protection laws of the country in which you live. We encourage you to contact us first so that we can try to resolve any concern informally.

18. General

These Terms, together with our Privacy Policy, are the entire agreement between you and ClassKite regarding the Service. If any provision is found unenforceable, the remaining provisions will stay in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets. Headings are for convenience only.
